TERMS AND CONDITIONS

1. General provisions

These Terms and Conditions (hereinafter, "Terms") govern access to and use of the web platform practimatch.com (hereinafter, "the Platform"), operated by PRACTIMATCH S.A.C., with Tax ID (RUC) No. 20612663441, domiciled in San Borja, Lima, Peru. By accessing, registering, or using the Platform, you fully accept these Terms and the Privacy Policy available at practimatch.com/en/privacy.

2. Definitions

Platform: The website practimatch.com and all associated services. Intern User: A natural person over 18 years of age who registers on the Platform to seek pre-professional internship or employment opportunities. Company User: A legal or natural person who registers to post job opportunities and access intern profiles. Partner University: An educational institution that maintains a collaboration agreement with Practimatch. Services: Job intermediation, profile matching, AI-assisted recommendations, and all features offered by the Platform. AI Tools: Platform features that use algorithms and artificial intelligence to generate recommendations, indicative rankings, and matching between profiles and opportunities.

3. Registration and user account

To use the Services, you must create an account by providing truthful, complete, and up-to-date information. You may register directly or through Google Sign-In. By registering with Google Sign-In, you authorize Practimatch to access your name, email address, and profile photo from your Google account, exclusively for authentication and initial profile creation purposes, as detailed in our Privacy Policy. Your use of Google Sign-In is also subject to the Google Terms of Service and the Google Privacy Policy. You are responsible for maintaining the confidentiality of your access credentials and all activity carried out under your account.

Age restriction: The Platform is intended exclusively for persons over eighteen (18) years of age. By registering, you declare and warrant that you meet this requirement.

4. Specific conditions for Intern Users

4.1 Use of the Platform

The Intern User may create and maintain a professional profile, apply for opportunities posted by Company Users, receive personalized opportunity recommendations generated with AI-assisted tools, and communicate with companies through the Platform. The User commits to providing truthful and up-to-date information in their profile and CV.

4.2 Profile visibility

By creating a profile, the Intern User accepts that certain profile information (name, university, major, skills, and other relevant data) will be visible to Company Users and Partner Universities registered on the Platform, in accordance with the available privacy settings and the applicable workflow. Data visibility is limited to the institutional environment (tenant) and the corresponding selection process, unless the operational flow requires additional visibility and the user has been duly informed.

4.3 Obligations of the Intern User

The Intern User is obligated to: use the Platform solely for legitimate internship or employment search purposes; not provide false, misleading, or fraudulent information; not use the Platform for illegal activities; respect the intellectual property of Practimatch and third parties; and not attempt to access accounts, data, or systems of other users.

5. Specific conditions for Company Users

5.1 Posting opportunities

The Company User may post pre-professional internship and employment opportunities, access profiles of interns who have applied or who match the search criteria, receive rankings and recommendations generated with AI-assisted tools, and manage selection processes through the Platform. Postings must be real, current, and comply with applicable Peruvian labor legislation.

5.2 Use of intern data

The Company User commits to: use intern data exclusively for recruitment and selection purposes within the Platform; not share, sell, or transfer intern data to third parties without authorization; comply with Law No. 29733 and Supreme Decree No. 016-2024-JUS regarding the processing of personal data obtained through the Platform; and responsibly manage intern data once the selection process has concluded, in accordance with applicable regulations and the Platform's terms of use.

Access to intern data is limited to the Company User's institutional environment within the Platform. Candidate data associated with other Company Users or Partner Universities is not accessible unless the operational flow requires it.

5.3 Obligations of the Company User

The Company User is obligated to: provide truthful information about the company and posted opportunities; comply with labor obligations established by Peruvian legislation, including Law No. 28518 on Formative Labor Modalities; not discriminate against candidates on grounds of race, gender, religion, sexual orientation, disability, or any other condition; and maintain professional conduct standards in all interactions with interns.

6. AI-assisted tools

The Platform incorporates AI-assisted tools that support features such as matching between profiles and opportunities, generating personalized recommendations, and producing indicative rankings. These tools are designed as support for the decision-making process and do not guarantee obtaining internships, employment, admission, or any other specific outcome. Final hiring, selection, or engagement decisions rest exclusively with Company Users, Partner Universities, or the institutions involved, as applicable. Practimatch is not responsible for selection decisions made by third parties based on information or recommendations provided by the Platform.

7. Intellectual property

All content on the Platform, including text, graphics, logos, icons, images, software, algorithms, and their structure, are the property of Practimatch or its licensors and are protected by the intellectual property laws of Peru and international treaties. Use of the Platform does not grant the user any ownership rights over this content. Users retain ownership of the data and content they upload to the Platform, granting Practimatch a non-exclusive license to use them in the provision of the Services, including the processing necessary for the operation of matching and recommendation tools.

8. Limitation of liability

Practimatch acts as an intermediation and employability tools platform and is not a party to the labor or formative relationship that may arise between Intern Users and Company Users. Practimatch does not guarantee obtaining internships or employment, nor the suitability of candidates. Rankings, recommendations, and matching results generated by the Platform are indicative and do not constitute a definitive assessment of aptitude or a guarantee of outcome. Practimatch shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform, including hiring or selection decisions based on information or recommendations from the Platform, except in cases of willful misconduct or inexcusable negligence under Peruvian law.

9. Suspension and termination

Practimatch reserves the right to suspend or cancel a user account in the event of: violation of these Terms or the Privacy Policy; publication of false or fraudulent information; misuse of the Platform; or by requirement of a competent authority. The user may request the cancellation of their account at any time by sending a request to soporte@practimatch.com. The processing of the associated data deletion request will be governed by the Privacy Policy.

10. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute arising from the use of the Platform shall be submitted to the jurisdiction of the competent courts of the city of Lima, Peru, with the parties waiving any other jurisdiction that may correspond to them.

11. Modifications

Practimatch reserves the right to modify these Terms at any time. Modifications will be notified to users through the Platform or by email with reasonable advance notice. Continued use of the Platform after notification of changes will constitute acceptance of the modified Terms.
